| ORDER |
WHEREAS consequent upon the creation of Uttaranchal w.e.f 9.11.2000 the Uttar Pradesh Bhootpurva Sainik Kalyan Nigam Limited continues to function in the Successor States of Uttar Pradesh and Uttaranchal. The Headquarters of the Corporation is situated at Lucknow.
AND WHEREAS Section 66 of the Uttar Pradesh Reorganisation Act, 2000 provides that companies specified in the Ninth Schedule to the Uttar Pradesh Reorganisation Act, 200 shall continue to function as before reorganisation of the composite State until in respect of the company concerned, law is passed, or an agreement has been reached between the Successor States or directions are issued by the Central Government.
AND WHEREAS the Government of Uttaranchal, has established the Uttaranchal Purva Sainik Kalyan Udham Ltd and incorporated it under the Companies Act, 1956 as Limited company on 1.3.2004. The main objects of the company, inter alia, are to provide employment/self employment to ex-servicemen and their dependents, provide financial assistance to ex-servicemen and their dependent family members in schemes approved by the company, impart and encourage training for entrepreneurship among ex-servicemen and their dependent family members, arrange for loans, etc.
AND WHEREAS the Ministry of Defence, Directorate General Resettlement in their letter No 2112/SA/ESM/Corporation/Emp 16.12.2005 has clarified to all Ex-servicemen’s Corporations (ESM Corporation) will be restricted to its own home state only. Directorate General Resettlement may consider sponsoring the ESM Corporation of another State/National Capital Region area at Directorate General Resettlement discretion where there is no ESM Corporation formed so far in that particular State, or for specialized tasks. However, once the home state ESM Corporation is formed and becomes operational, automatically the outside ESM Corporation will relinquish the sponsorship outside their home State and hand over existing security contract to the newly formed State ESM Corporation after serving notice to the principal Employer as per the condition laid down in the contractual agreement.

AND WHEREAS the Government of Uttaranchal has indicated that it will not stake its claim in the assets and liabilities of the Uttar Pradesh Bhootpurva Sainik Kalyan Nigam, Limited.
AND WHEREAS the Government of Uttaranchal has requested the Central Government to issue directions under provisions of the Uttar Pradesh Reorganisation Act, 2000 to limit the operation of the Uttar Pradesh Bhootpurva Sainik Kalyan Nigam, Limited within the state of Uttar Pradesh.
AND WHEREAS the central Government requested for comments/view of Government of Uttar Pradesh on the proposal of the Government of Uttaranchal by 28.2.2006.
AND WHERAS no comments/view of Government of Uttar Pradesh were received by 28.2.2006.
Now therefore, in exercise of powers conferred by Section 66 of the Uttar Pradesh Reorganisation Act, 2000, the Central Government hereby directs that with immediate effect, the area of jurisdiction of Uttar Pradesh Bhootpurva Sainik Kalyan Nigam, Limited will be limited within the territory of Uttar Pradesh. |
