Security Agency Guidelines:
PF/EPF AND ESI
56. NO security agency is exempted from PF/EPF.  The earlier exemption for agencies employing 100% Ex-servicemen has been withdrawn vide Gazette notification No.  S-35025/2/2004-SS-II) dated 17 Aug 2004 (Appendix ‘T’). It is mandatory for all agencies to submit complete nominal rolls of all their employees with their respective PF codes within 45 days of the award of contract. Newly empanelled agencies not having PF No. and labour licence may deposit EPF contribution in the account of the principal Employer for the initial period of 3 months.  All employees are to be covered under the ESI Scheme.  In Coal belt areas or such areas where ESI Scheme does not exist, the agency is to take up equivalent insurance cover from Insurance Company after approval from the DGR.  For the same, the agency is required to forward a certificate/letter from the local authorities that ESI Scheme is not available in the area.  As per Govt directives any agency engaged in the profession of employing manpower of 20 or more is required to be covered under the Act of ESI, PF and the Contract Labour Act.  It is pertinent to mention that as per existing Govt orders the proof of deposit of Employer’s contribution should be sent to the concerned Employer regularly and to the DGR one month after commencement of contract and thereafter on yearly basis on 31 Jan of ensuring year. EPF and ESI should be deposited in respect of all guards regularly and they should be issued with EPF and ESI cards, so that they can check their account whenever they wish to and also avail ESI facilities for themselves and their family members.
