Security Agency Guidelines:
SPONSORSHIP NORMS
20.
  1. Sponsorship/ sponsorship letter(definition). The document by which the DGR forwards a panel of recommended security agencies to a CPSU/principal employer for the latter.s limited tendering action.
  2. Re- sponsorship/Responsorship letter. The letter by which the DGR recommends a security agency to a location where the agency has rendered good service in the preceding two years. For details see Para 26.
  3. All PSUs must ensure that contracts are concluded within three months of issue of sponsorship. For details regarding requisition by the CPSU/Principal Employer refer Para 48.
  4. The sponsorship of a security agency to a Principle Employer will be done in the order of their seniority of registration at DGR. State wise seniority roster is being maintained at the DGR for the purpose.
  5. While sponsoring an agency it will be checked whether the agency has been adhering to DGR instructions.
  6. Sponsorship including cases of re-sponsorship will be done only if the proprietor/Director(s) are below 63 years of age. The agency so sponsored may work till the proprietor/director attains 65 years of age. Responsorship may be done for one year till the proprietor/director attains 64 years. Responsorship will be done only based on Appendix .K. and meeting other laid down norms.
  7. Sponsorship will be initially for a period of two years. All agencies are eligible for responsorship in accordance with conditions given in Para 26. In case the employer makes an agreement for one year the sponsorship will be considered for extension to the second year unless specifically requested otherwise by the principal employer.
  8. Maximum period of sponsorship including re-sponsorship of an agency to a particular employer at a particular location will be limited to two years of sponsorship initially. This may be followed by another two years of responsorship. Four years is not guaranteed in one go. It will be treated in two parts where the responsorship will be ONLY done BY THE DGR BY ISSUANCE OF RESPONSORSHIP LETTER. All conditions in Para 26 are binding for responsorship. This is to provide equal opportunity to service personnel retiring each year. RESPONSORSHIP IS NOT A MATTER OF RIGHT. IT HAS TO BE IN ACCORDANCE WITH CONDITIONS IN PARA 26.
  9. In case all agencies in a particular state have been allotted their quota of security guards then agencies that have given second or third choice, as the state under reference will be sponsored provided they have not completed their quota of guards. In such an eventuality, it will be ensured, as far as possible, that the cumulative numbers of guards are economically viable.
  10. The DGR will not be responsible for securing the award of contracts.
  11. In case of a private limited company the following will be strictly adhered to:-
    1. Age of the youngest director of the company should not be more than 63 years for a fresh sponsorship. Re-sponsorship for one year may be done till the youngest director attains 64 years of age.
    2. Change of director(s) is not permissible under any circumstance except in the case of induction new director(s) in addition to the existing directors. In case of demise of a director(s) during the company.s term with the DGR, then the following will be done:-
      1. The Private ltd company ceases to be on the sponsorship panel of the DGR.
      2. Any contract in execution will complete its normal full term. Such companies will not be responsored.
      3. Benefit of the contract in execution will be given to the NOK of the deceased director.
      4. Provided that the remaining directors have not crossed 63 years of age and also not deployed their authorised quota of guards, in such case the remaining directors may seek to revert to individual proprietorship from the DGR. Such cases will be viewed on a case-to-case basis. However they will not be permitted to join any other Pvt limited company or form another private limited company in their tenure with the DGR.
      5. The company will not be permitted to revert to individual proprietorship because any of the directors have become overage and that they have not managed to deploy their authorised number of guards. The DGR will ensure adequate sponsorships provided adequate time period is available before any of the director(s) becomes overage. The DGR will however not be responsible for securing of contracts in any case.
  12. In case all the agencies sponsored to an employer quote same rates in their tender, then the employer should award the contract to the senior most agencies. However the principal employer may refer this case to the DGR for advice if required.
Agreement between agency & employer - It will be for two years. In case a Dep.t has restriction of one year same will be extended to the next year on the condition that the DGR had issued the sponsorship for two years initially. In case the contract is for one year, then it is the responsibility of the proprietor/director and principal employer to intimate such details to the DGR immediately on entering into the contract/ not later than one month of entering into contract giving details of such agencies and no of guards deployed. In case there is a termination clause minimum notice period will be one month and no agency will be terminated without taking concurrence of the DGR.
